Terms & Conditions

The following terms and conditions are applicable for all the courier/cargo/logistics services provided to the customer/shipper/consignee directly or indirectly by UPX International Cargo LLC. It is understood that when the customer initiates a shipment booking, they accept these terms for themselves and anyone else interested in the shipment. These terms and conditions also cover anyone UPX may contract to collect, transport or deliver your shipment. No UPX International Cargo LLC(UAE) employee or anyone else can change our terms and conditions or make any promise on our behalf.

  • The customer appoints UPX or any other third party that UPX decides as an agent to conduct customs clearance and entry and certify UPX International Cargo LLC as consignee solely to designate a customs broker to perform customs clearance and entry. The customer certifies that shipment details are complete and accurate per the packing list and shipping documents provided.
  • UPX does not accept, as a shipment, anything that is restricted by IATA (International Air and Sea Transport Association) or ICAO (International Civil Aviation Organization). The following items (or any item similar in description or content) cannot be carried on any personal effects service. Any person sending such an item may be subject to their order being cancelled or seized without notice by concerned parties, and the customer is liable to pay the fines/penalties imposed by the authorities: Aerosol, Air Bag, Alcoholic Beverages, All Batteries, , Animals of Any Form (Alive or Dead) , Biological Samples, Liquid, Cash/Currency, Cheques, Cigarettes/Tobacco/ Cigar, Cooked/Homemade food, Corrosives, Crackers, Dangerous Goods, Drugs (Including Prescription)/Narcotics, Filth, Fire Extinguisher, Fish (Live Or Dead) , Gambling items/machines, Gun, Hazardous Goods, High-value goods, Human Remains, Infectious Substances, Ivory, Imitations – fake bags, replica watches, replica electronics, Juice, Jewellery, Precious metals – Gold, Silver, Branded watches, Lottery Tickets, Meat, Medicines – Vitamins & supplements, Radioactive/Radiation polluted substances, Motor Oil, Original Engravings, prints, lithographs, sculptures & logos, Petroleum/LPG/Crude, Pesticides/ Insecticides, Pirated CD/ACD or any form of storage with pirated data, Poisonous materials, Printed publications, stony sculptors, and mannequins contrary to Islamic teachings, Products that will spoil, Products made from/with pork, Products imported/Coming from boycotted countries, Products from Israel or products that have Israeli trademarks & logos.
  • The customer agrees that UPX/Integrator/Customs may open and inspect a shipment for any reason without notice to the customer. The chargeable weight would be the gross or volumetric weight, whichever is higher. (Volumetric weight calculation method L*H*W/5000 for air courier mode, L*H*W/6000 for air cargo mode and L*H*W/4000 for road transportation). If the shipment weight varies, the rate will change according to the final weight (without prior notification).
  • If the customer wishes to claim for a lost (including wrongly delivered) or damaged shipment.
           1) Customer must claim in writing.
           2) UPX must receive the claim within seven days from the date of delivery or committed delivery date.
           3) Please send or take your claim to UPX International Cargo LLC’s head office.
           4) By the conditions below, UPX International Cargo and its employees and agents are not liable for certain losses and damage. Wherever they are to be liable, the amount of liability is strictly limited, not exceeding USD 100. The Customers are therefore advised to purchase insurance coverage from a third party to protect their interests. At the customer's request and upon payment, therefore, at the prevailing rates, UPX International Cargo will try to arrange third-party insurance coverage on behalf of the customer in the amount equivalent to the value of the invoice produced by the shippers. But in that case, UPX is not responsible for any insurance claim support. The customer must follow all further claiming procedures directly with the insurance companies. The covered insurance shall be governed by all the terms and conditions in the insurance policy issued by the insurance company. A certificate evidencing such insurance will be made available to the shipper.
  • In case the goods attract duties at the destination port, the same is payable by the receiver. UPX and related parties are not responsible for any delay or otherwise due to the non-cooperation of the receiver. However, additional charges, as given below and as decided by UPX on a case to case basis, would be collected from the receiver in advance before clearing the shipment from customs.
  • We shall make every reasonable effort to deliver your shipment according to our regular delivery schedule, but we are not liable if a shipment is lost, damaged, delayed or misdelivered because circumstances beyond our control include
           1)Natural disasters like earthquakes, cyclone storms, floods, pandemics etc.
           2) Force Majeure, like war, plane crash, strike, riot, or embargo
           3) Any defect or characteristic with the nature of the shipment. Even if it is known to us when we accept it
           4) Any action or omission by anyone outside UPX International Cargo i.e
           a) The sender of the shipment
           b) The receiver of the shipment
           c) An interested third party
           d) Customs or other government officials
           e) The postal service, other carrier or third party that we contract to serve locations that we do not serve directly
    We are not liable even if the sender did not ask for or know about a third-party arrangement.
  • We are also not liable for electrical or magnetic damage to or ensure electronic or photographic images or recordings are damaged on account of handling in transit.
  • UPX are not liable for the following, whether they arise in contract or any other form of civil action, including negligence and even if they are our fault.
           o consequential or special damages or losses
           o Other indirect losses
           o Breach of other contracts
           o Consequential damages or losses include, but are not limited to, lost income, profits, interest, markets, loss of contracts/Goodwill
  • If the transportation of a shipment involves an ultimate destination or stop in a country other than the country of departure, the Warsaw Convention may apply. The convention governs and, in most cases, furthest limits, liability or damage to such shipment.
  • UPX International Cargo LLC will not give a hard copy of POD to the customer or related parties.
  • UPX International Cargo does not take any responsibility whatsoever for service failure (i.e., delay / non-delivery) if you book a consignment without telephone/fax no: / improper/incomplete address/refusal to accept the shipment by the receiver.
  • Any change in origin, destination, Surcharges, etc., will result in a variance in the rate quoted. Customers have to contact and confirm the rates by email with UPX before making the booking every time.
  • Fuel surcharge is based on the variable fuel index of the invoicing date or month.
  • Transit time by air courier and cargo will depend on the destination country and excludes the time for customs formalities.
  • Increased transit time and additional cost might incur for any shipment with a weight exceeding 999 kgs or 300x200x150 in dimensions or ten numbers of pieces. These dimensions and numbers may change depending on the integrators’ policies.
  • Value Added Surcharges, Duty, Tax, FSC, ESC, CSC, BOE Charges, Tolls, Special economic zone/Free Zone charges and Government levies are excluded in tour rate sheets and quotations unless stated separately.
  • UPX International Cargo LLC is not authorised or allowed to make shipments below 30Kgs. Suppose the shipment is below 30Kgs which is not with the knowledge of UPX. In that case, the customer will be responsible for all the legal and financial consequences and liable to pay any penalties imposed by any government official entities.
  • All the rates apply for couriers or cargo billed in the UAE.
  • UPX International Cargo LLC works only as an agent and is not responsible for shipment delays, loss, extra charges, or penalties by any other parties.
  • As personal effects, the following items (or any item similar in description or content) can only be carried on a no-compensation basis through any services. Any person sending such a thing does so at their own risk: Amber, Antique, Beswick Figure, Bottles, Bulbs, Camera, Canvas Print, Car Door, Car Panel, Ceramics, Chandeliers, Chocolate, , Computer Monitor, Confectionary, Crockery, Delicate items, Detergent, Diamonds, Dinner Set, Dry Fruits, Electronics items without original product packing, Fiberglass, Figurine, Fish Tank, Fishing Rods, Food, All Fragile Items, Frames, Framed or unframed Painting/ Photograph/Pictures, Gems Or Gemstones, Glass, Glassware, Guitar, Hamper, Headlight, Jewelry, Lamp, Lenses, Lighting/Lights, Marble, Microscope, Microwave, Mirror, Monitor etc.
  • BOE and export/import declaration charges from the country of loading and country of delivery will be added to the quoted rates if applicable.

  • If the pickup or delivery location is listed as out of service area by the integrator, either the customer has to make the arrangments or will be charged extra per the additional charges requested by the service provider.
  • All the clearance formalities are the responsibilities of the consignee for all consignee clearance/agent clearance countries, such as Turkey, Sri Lanka, African countries, etc. It is the responsibility of the customer to understand the customs clearance methods and formalities before initiating any shipment booking through UPX.
  • The shipper and consignee are responsible for providing all necessary shipping documents requested by the integrator and customs. UPX will not be liable for delays or consequences if the documents are submitted on time.
  • Doing insurance is the customers’ responsibility. Any insurance or uninsured claims by the customer must be dealt with by the integrator or insurance companies UPX will not be responsible for any damage, loss or delay of the shipment.
